These Terms govern your use of the Parostok mobile application. By downloading or using Parostok, you agree to them. Please also read our Privacy Policy.
1 Acceptance of these Terms
Parostok (Паросток) is a mobile gardening application operated by Dariia Tieriekhova, Rivne, Ukraine ("we", "us"). By creating an account or using the app, you enter into a binding agreement with us on these Terms. If you do not agree, please do not use Parostok.
2 Who can use Parostok
You must be at least 16 years old to create an account and use the app, unless a parent or legal guardian provides the consent required in your country. By using Parostok you confirm that you meet this requirement.
Parostok is currently designed for growers in Ukraine. Certain features — including region selection and weather — are limited to supported Ukrainian regions, which you choose yourself from a list within the app.
3 Your account
You sign in using Sign in with Apple or Sign in with Google. You are responsible for keeping access to your account secure and for activity that occurs under it. Please tell us promptly if you believe your account has been used without your permission. You can delete your account at any time from Profile → Delete account.
4 What Parostok provides
Parostok offers plant care guidance, lifecycle tracking, checklists, a growing journal, daily tips, and an in-app AI assistant ("Пан Тепличний"). All of this is provided for general informational and educational purposes to support home gardening.
5 AI assistant
The AI assistant generates responses automatically using AI technology provided by Anthropic. Its answers can be inaccurate, incomplete, or outdated. Treat them as suggestions, not authoritative instructions, and use your own judgment. We are not responsible for outcomes resulting from reliance on AI-generated content. Please do not enter sensitive personal information into the chat. How your messages are processed is described in our Privacy Policy.
6 Subscriptions, trials, and payments
Parostok offers a free tier and a paid subscription, Parostok Plus, at $3.99 per month (or the local equivalent set by the app store). Plus increases your monthly allowance of AI requests and unlocks additional features.
- AI usage limits. Each tier includes a monthly allowance of AI assistant requests. When you reach your allowance, AI replies pause until it renews in the next period or until you upgrade; other features remain available. We may adjust allowances and limits over time to keep the service reliable and sustainable, but we will not remove a paid benefit you have already been charged for in the current billing period.
- Free trial. A free trial may be offered. Eligibility for and enforcement of trials is determined by the app stores; you may not be eligible for more than one trial.
- Billing and auto-renewal. Subscriptions are sold and billed by Apple or Google, not by us. They renew automatically for the same period unless you cancel at least 24 hours before the current period ends.
- Managing and cancelling. Manage or cancel your subscription in your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Deleting your Parostok account does not automatically cancel your subscription.
- Refunds. Refunds are handled by the app store under its own policies; we generally cannot issue refunds directly.
- Price changes. We may change subscription prices for the future. If we do, existing subscribers may keep their current price where the app stores support this. We will not increase your price without the notice the stores require.
7 Acceptable use
When using Parostok, you agree not to:
- use the app for any unlawful purpose or in breach of these Terms;
- attempt to disrupt, overload, or gain unauthorized access to the service or its backend;
- circumvent usage limits, security measures, or subscription controls;
- reverse engineer, copy, or resell the app except as permitted by law;
- submit content that is illegal, harmful, or infringes the rights of others.
8 Content and intellectual property
The app, including its design, text, plant data, and the "Пан Тепличний" character, is owned by us and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Parostok for your own gardening. You may not use our trademarks, logos, or branding without our prior written permission.
You keep ownership of the content you create (journal entries, logs, and similar). You grant us the limited licence needed to store, process, and display that content so we can operate the service for you.
9 App store terms
You obtain Parostok through the Apple App Store or Google Play, and their terms also apply to your download and use of the app.
If you obtained Parostok from the Apple App Store, the following additionally applies: these Terms are concluded between you and us only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple's standard Licensed Application End User License Agreement (Apple's Standard EULA) also applies to the extent these Terms are less restrictive or conflict with it. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a relevant embargo and are not on any prohibited-party list.
If you obtained Parostok from Google Play, the Google Play Terms of Service also apply.
10 Availability and changes
Parostok is provided on an "as is" and "as available" basis. We may update, change, suspend, or discontinue features — or the whole app — at any time, and we do not guarantee uninterrupted or error-free operation. Some features depend on third-party services that may themselves change or become unavailable.
11 Events beyond our control
We are not liable for any failure or delay in providing Parostok caused by events beyond our reasonable control. These include, among others, power outages, internet or network disruptions, failures or changes of third-party services (such as the app stores, hosting, weather, or AI providers), natural disasters, armed conflict, war, or measures taken by authorities. This is particularly relevant given current conditions in Ukraine.
12 Disclaimers and limitation of liability
To the fullest extent permitted by law, Parostok is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose. We are not liable for indirect, incidental, or consequential damages, or for lost plants, crops, data, or profits, arising from your use of or inability to use the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
13 Termination
You may stop using Parostok and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the app in a way that harms the service or other users. On termination, the sections that by their nature should survive — including intellectual property, disclaimers, and limitation of liability — remain in effect.
14 Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. If you have a concern, please contact us first at tieriekhova.dariia@gmail.com so we can try to resolve it informally before either of us pursues other remedies. These Terms are additional to the terms of the app store from which you obtained Parostok.
15 Changes to these Terms
We may update these Terms as the app develops. When we make material changes, we will update the date at the top and, where appropriate, notify you in the app. Continued use of Parostok after an update means you accept the revised Terms.
