The short version. Arrows In! is a puzzle game you may play for personal enjoyment. Ads and optional purchases pay for it. Purchased items are a licence to use them inside the Game, not property, and they live on your device — there is no cloud save, so uninstalling the Game or clearing its data loses your progress and your unused hints and undo refills. One-time purchases such as “No ads” and themes can be restored. Nothing here takes away the consumer rights your own country’s law gives you.
1. These terms
These Terms of Use (the “Terms”) are an agreement between you and Dariia Tieriekhova, an independent developer based in Ukraine (“we”, “us”), about the Arrows In! mobile game for iOS and Android, including its updates, content and in-app purchases (the “Game”). By downloading, launching or playing the Game you accept these Terms. If you do not accept them, do not use the Game and delete it.
How we handle data is described separately in the Privacy Policy, which forms part of these Terms.
These Terms are written to work in every country the Game is sold in. Where your local law gives you rights these Terms do not, you have those rights anyway; where it forbids something these Terms allow, the local rule wins and the rest of the Terms stay in force. Section 16 spells this out for the largest regions.
2. Who may play
You must be at least 13 years old to use the Game. If you are under the age of majority where you live, you may use the Game only with the consent of a parent or guardian, who then accepts these Terms on your behalf and is responsible for any purchases made on the device. The Game is not directed to children, and we do not offer it in any store’s children’s category.
3. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment, in accordance with these Terms and with the rules of the store you installed it from. That is all the licence gives you: the Game is licensed, not sold, and we keep every right we do not grant here.
4. What you may not do
- Copy, sell, rent, sublicense or redistribute the Game or its content, including level layouts, shapes, icons and artwork, except as the store’s own rules allow.
- Reverse engineer, decompile or disassemble the Game, or extract its content, except to the extent the law expressly permits — including the interoperability and error-correction rights under EU Directive 2009/24/EC and equivalent laws — and only within those limits.
- Modify the Game or its saved data, or use tools, emulators, patched clients or automation, in order to unlock levels, crowns, hints, undo refills or paid items you have not earned or bought.
- Interfere with advertising or purchase flows, or attempt to obtain rewards without meeting their conditions.
- Use the Game in any way that breaks the law, or that interferes with other players’ devices or the services the Game relies on.
If you do any of this, your licence ends automatically. There is nothing for us to ban, because there are no accounts — but a modified Game may stop working, lose progress or fail to recognise your purchases, and that is not something we can repair.
5. Progress lives on your device
The Game has no account and no cloud save. Your progress, crowns, settings and your stock of hints and undo refills are stored on the device only. This means, plainly:
- uninstalling the Game, clearing its data, or switching to another device loses your progress and any unused hints and undo refills;
- a lost, wiped or broken device loses them too, and we cannot recover or recreate them, because we never had a copy;
- one-time purchases — “No ads” and board themes — are held by the store and can be brought back with Settings → Restore purchases on the same store account;
- on Android, your system backup may happen to preserve app data, but that is a function of your device and Google account, not a promise from us.
We are telling you this before you buy, not after. If losing progress on reinstall would trouble you, take it into account when deciding to purchase.
6. Virtual items
Hints, undo refills, gold marks, crowns, unlocked levels, board themes and any other in-game item or currency (“virtual items”) are a limited licence to use a feature inside the Game. They are not your property, have no monetary value, and cannot be sold, traded, transferred or exchanged for cash or anything outside the Game.
Because the Game is a living product, we may add, change, rebalance or discontinue virtual items, levels, prices, reward amounts and difficulty, including remotely and without a new release. We will not take away a one-time purchase you have already paid for, such as “No ads” or a theme, for as long as it is technically possible to provide it; if we ever have to withdraw a paid feature permanently, we will say so in the store release notes, and where your law entitles you to a remedy for that, you keep it.
Consumable items are used up as you use them. Buying more is always optional: the Game gives hints and undo refills for free through the reward ladder as you progress, in exchange for crowns you earn by solving levels perfectly, and in exchange for watching an ad.
7. Advertising
The Game is free to install and is paid for by advertising and optional purchases. There are two kinds of ads. Rewarded videos are your choice: you watch one in exchange for a hint, an undo refill, early access to a hard level or replaying a level you have already completed. Interstitials are shown occasionally after you tap Next on the victory screen, from level 20 onwards, and after you restart a level; never during your first session, never more often than once every two minutes, and never in the Extreme section.
The one-time “No ads” purchase removes all interstitial ads and opens hard levels and replays without a video. Rewarded videos stay available if you choose to watch one for a hint or an undo refill; “No ads” does not make hints or undo refills unlimited. It does not remove the optional purchases themselves, and it does not affect the anonymous statistics described in the Privacy Policy.
Ads come from Google’s network and we do not choose the individual ad you see. If an ad is inappropriate, deceptive or does not belong in a game rated for a general audience, send us the details and we will report it.
8. Purchases and prices
All purchases are made through the Apple App Store or Google Play, under that store’s terms and with that store’s payment methods. We never see your payment details. The store’s receipt is the record of your purchase. Every purchase is a one-time purchase: the Game has no subscriptions and nothing renews automatically.
Prices and offers differ between players and over time. Prices vary by country and currency; we run limited-time offers and discounts; a starter pack is offered to players who have never purchased; and the price level of the packs is set automatically from your purchase history in this Game, including a discount for returning players. So the price you see is not necessarily the price another player sees. We say this openly because EU consumer law requires it and because you deserve to know. The price shown in the store’s own confirmation dialog, before you confirm, is always the price you pay, in your own currency and including the taxes the store adds.
Manage or disable purchases on the device through your store account settings; parents can restrict in-app purchases in the device’s screen-time or parental control settings.
9. Cancellation and refunds
Purchases are digital content delivered immediately, so they are generally not refundable once delivered. That does not touch your statutory rights:
- EU, EEA and UK. You normally have 14 days to withdraw from a purchase of digital content. By confirming a purchase in the Game you expressly request immediate delivery and acknowledge that you lose the right of withdrawal once delivery has begun. You keep every other statutory right, including the right to have content that does not conform to its description brought into conformity, or to a price reduction or refund.
- Everywhere. Refunds are handled by the store you bought from: reportaproblem.apple.com for the App Store, or your order history on Google Play. We cannot issue a refund ourselves, but if something is our fault, write to us and we will support your request with the store.
- If a purchase is charged and the item does not appear, first use Settings → Restore purchases, then write to us with the store receipt and we will sort it out.
10. Updates and availability
We may update the Game, including by downloading small over-the-air updates to its non-native code, to fix defects, balance difficulty or add content. Updates may change or remove features. We may stop distributing or supporting the Game, or discontinue it entirely; if we do, the copy installed on your device keeps working for as long as your device and operating system allow, but new purchases and restores depend on the stores.
The Game is free to download and we do not promise uninterrupted availability. Advertising, purchases, restores and updates depend on third-party services that we do not control.
11. Our content
The Game, its name, its artwork, shape and level design, icons, text, code and sound are owned by us or licensed to us, and are protected by copyright and other laws. You may take screenshots and record video of your own play and share it, including on monetised channels, provided you do not present the Game as your own, do not use our name or artwork to suggest we endorse you, and do not distribute the Game’s files or content packs themselves.
12. Third-party services
The Game uses services from Google (advertising, statistics, crash reporting and remote configuration), Apple and Google (payments) and Expo (updates). Your use of the Game is also subject to their terms, and their handling of data is described in the Privacy Policy. We are not responsible for those services’ own conduct, but we are responsible for choosing them and for what we ask them to do.
13. No warranty
The Game is provided “as is” and “as available”. To the fullest extent permitted by the law that applies to you, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant uninterrupted or error-free operation, or that difficulty is identical for every player.
If you are a consumer, you have statutory rights that cannot be excluded — including, in the EU and the UK, the right to digital content that conforms to the contract; in Australia, the consumer guarantees under the Australian Consumer Law, which entitle you to a replacement or refund for a major failure and to compensation for reasonably foreseeable loss; in New Zealand, the Consumer Guarantees Act; and comparable rights elsewhere. Nothing in these Terms excludes, restricts or modifies those rights, and where a warranty is implied by law and cannot be excluded, this section does not apply to it.
14. Liability
To the extent permitted by the law that applies to you, we are not liable for indirect or consequential loss, for lost progress, virtual items or purchases caused by uninstalling the Game, clearing its data, losing a device or modifying the Game, or for loss caused by third-party services being unavailable. Where we are liable, our total liability for all claims is limited to the greater of the amount you paid us for in-app purchases in the 12 months before the claim, or EUR 50.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, for breach of a fundamental obligation of this agreement, or for anything else that cannot be excluded under the law that applies to you as a consumer. In some countries these limits simply do not apply to you; there, our liability is what that law says it is.
15. Termination
You may end this agreement at any time by deleting the Game. Your licence ends automatically if you breach section 4. We may end it by written notice if you breach these Terms in a way we cannot reasonably resolve. When the agreement ends you must stop using the Game and delete it; sections 6, 11, 13, 14 and 17 survive.
16. Governing law, disputes and your local rights
These Terms are governed by the law of Ukraine, and the courts of Ukraine have jurisdiction. If you are a consumer, this does not deprive you of anything. You keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts wherever that law gives you the right to do so. In particular:
- EU and EEA: your rights under the Consumer Rights, Digital Content and Unfair Terms directives apply, and you may use the European Commission’s online dispute resolution platform. We are not obliged, and do not undertake, to take part in alternative dispute resolution before a consumer arbitration body, but we do answer every complaint that reaches us.
- United Kingdom: the Consumer Rights Act 2015 applies to digital content you buy from us.
- United States: nothing here waives your right to bring an individual claim in small claims court. These Terms contain no arbitration clause and no class-action waiver.
- Australia and New Zealand: the consumer guarantees named in section 13 apply and cannot be contracted out of.
- Canada, Brazil, Japan, Korea, India, South Africa and elsewhere: your national consumer law applies to the extent it is mandatory, and prevails over any conflicting term here.
Before going to court, please write to us: most problems with a purchase, a lost unlock or a stuck level are settled by email in a day or two.
17. General
- Severability. If a court or authority finds any provision unenforceable in your country, that provision is limited or removed to the minimum extent necessary, and the rest of the Terms remain in force.
- No waiver. If we do not enforce a provision, we have not given it up.
- Assignment. You may not transfer these Terms. We may transfer them to a successor who takes over the Game, on written notice in the store listing or on this page; your rights do not shrink because of it.
- Force majeure. Neither of us is liable for a failure caused by something genuinely outside our control, including war, natural disaster or the failure of a provider on which the Game depends.
- Notices. We reach you through the store listing, the Game itself or this page; you reach us at the email address in section 19.
- Language. These Terms are written in English. A translation is provided for convenience only, unless your law gives the translation precedence.
- Export and sanctions. You may not use the Game where doing so would breach applicable export control or sanctions law.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement about the Game between you and us, and replace anything said earlier — except any statement we have actually made to you, on which you were entitled to rely.
18. Terms required by Apple
For the Game installed from the App Store, the following applies and prevails over anything inconsistent above:
- These Terms are between you and us only, not with Apple, and we alone are responsible for the Game and its content.
- Your licence to use the Game is limited to a non-transferable licence to use it on any Apple-branded product you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Game, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Game.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the Game, including product liability claims, claims that the Game fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- If a third party claims the Game or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
- Support contact for the Game: tieriekhova.dariia@gmail.com.
For the Game installed from Google Play, the Google Play Terms of Service apply in addition to these Terms.
